DISPUTES ON COMPLIANCE OF ANY NORMATIVE ACTS OF THE CIS MEMBER-STATES WITH THE TREATIES AND OTHER ACTS ADOPTED WITHIN CIS

 

 

During the entire period of the CIS Economic Court functioning only one dispute, based on the claim raised by the Government of the Republic of Tajikistan against the Government of the Republic of Uzbekistan concerning non-compliance of Ordinance of the Cabinet of Ministers of the Republic of Uzbekistan ‘On Ban on Ethyl Alcohol Import and Transit into the Customs Territory of the Republic of Uzbekistan’ No. 213 dated May 15, 1998, with the treaties and other acts adopted within the Commonwealth of Independent States, and recovery of damages (Judgment No. 01-1/1-03 dated February 13, 2004), was related to conflict between the rules of law of the CIS-State and other acts adopted within CIS.

 

To justify its claim, the Government of the Republic of Tajikistan referred to violation, by the Government of the Republic of Uzbekistan, of its obligations arising from the number of treaties and other acts adopted within the CIS. Ordinance No. 213 banned ethyl alcohol import into the territory of the Republic of Uzbekistan, and its transit had to be carried out in exclusive cases on permissive basis. Subsequently, the cargo detained — 26 carriages of ethyl alcohol — was forfeited for the benefit of the State as a subject of illegal transit through the territory of the Republic of Uzbekistan, in which consequence the amounts of taxes and customs payments have failed to arrive at the budget of the Republic of Tajikistan.

 

Having examined the records of the case, the CIS Economic Court has passed the judgment to allow the claim of the Government of the Republic of Tajikistan partially, by declaring paragraphs 1 and 2 in Ordinance No. 213 non-complying with the provisions in force as of the date of the CIS acts adoption. The Court has recommended that the Government of the Republic of Uzbekistan should abrogate such mentioned provisions and apply remedies for elimination of any consequences caused by Ordinance No. 213.

 

The claim of the Republic of Tajikistan for recovery of damages inflicted by such forfeiture of ethyl alcohol for the benefit of the Republic of Uzbekistan was shelved by the CIS Economic Court in view of non-submission of the documents required for the dispute settlement.
